General conditions of Sale


  1. Scope of the General Conditions of Sale

These Conditions of Sale govern the purchase of Caffè Dokito branded products and accessories owned by the company Dicos Group s.r.l, made through www.dokito.it (hereinafter “the Site”). The same are formulated and provided in compliance with the provisions of Legislative Decree 6 September 2005 n. 206 (so-called “Consumer Code”) and any other law on consumer protection and applicable to electronic commerce.

The applicable General Conditions of Sale are those in force at the time the Customer confirms the dispatch of the order in the manner provided for in art. 4. By placing a purchase order, the Customer declares to be aware of and fully accept the conditions of sale. Their acceptance is a necessary condition for the conclusion of the contract.

  1. Parties to the contract

The parties to the contract are as follows:

– Customer: the end user is a natural person (as long as he is of age – if a natural person – at the date of conclusion of the contract) or legal entity, for example: professionals, small companies). For large companies, further forms of agreement are envisaged.

  1. Characteristics and prices of products or services

The essential characteristics of the products can be found on the Site within the dedicated product page. However, the images and colour of the products may vary (for example: due to the different rendering of the video or modification of the packaging).

The products are offered at the price indicated on the Site at the time the Customer confirms the dispatch of the order in the manner provided for in art. 4. Prices are inclusive of VAT which will be indicated in detail in the purchase invoice of the product, if issued. However, they do not include transport and delivery costs, which will in any case be indicated separately in the final summary section, which can be consulted before sending the order, and in any case specified in the order summary sent by e-mail to the Customer.

  1. How to conclude the Contract

The Customer can proceed with the purchase through the Site.

  1. a) Conclusion via the Site

To make an online purchase, only the data necessary for delivery and any billing of the order will be required.

Once the purchase order has been received from the Customer, Dicos Group srl will send a confirmation of receipt by e-mail, in which all the details of the order will be summarized. The order can be considered validly placed only after confirmation of receipt by Dicos Group srl..

At the same time, Dicos Group srl will check the availability of the ordered Product and, only after this verification, will it communicate its acceptance by e-mail and will start the procedures for shipping the product.

In the event that Dicos Group srl is unable to fulfil an order received, it will promptly notify the Customer. In this case, the order is considered cancelled and no amount will be charged to the Customer.

Any right of the customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things caused by the non-acceptance of an order.

  1. Terms of sale

The quantities of Products that can be ordered may be subject to minimum or maximum quantity limitations at the discretion of Dicos Group srl, based on active promotions.

Where existing, the promotional codes offered by Dicos Group srl and its partners are valid only for the products and during the period indicated from time to time. Promotional codes are non-refundable and cannot be combined. To take advantage of the discounts and / or offers linked to promotional codes, you must enter the promotional code in the appropriate space when validating the order on the site or communicate it to the Customer Care operator. Subsequently, it will not be possible to change the order to enter the discount code.

The language available to conclude the contract is Italian.

  1. Methods of payment

Dicos Group srl accepts payments only through the systems listed below:

  1. a) Credit card: (American Express, Visa or Mastercard) through the PayPal payment platform. The amount of the order will be charged only at the time of the actual approval of the order.
  2. b) PayPal: online payment system that allows any company or consumer who has an e-mail address to send and receive payments, after registration. Payment is made through the PayPal payment platform.
  3. c) Cash on delivery: payment will be made in cash to the express courier upon delivery.
  4. Shipping of products

Dicos Group srl will ship the purchased products exclusively to the destination specified in the order. We do not accept shipments to post office boxes.

Dicos Group srl will ship the products ordered by the Customer, by courier, to the address indicated by the same at the time of purchase, approximately within 24-48 working hours from the acceptance of the order. Delivery generally takes place within 4 working days. The times indicated for the receipt of the goods are indicative.

Delivery costs are calculated on the basis of the rates indicated on the Site.

The shipment will be made by Dicos Group srl via courier, which is responsible for the delivery. Dicos Group srl undertakes to collect any reports of non-delivery or delayed delivery of the products through the Customer Service and, if necessary, to assist the Customer in protecting their rights as required by law.

Delivery to the floor is not included in the service.

  1. Product verification and return

Any damage to the packaging and / or the product (visible without the need to open the package) or the mismatch in the number of packages must be immediately reported, by placing a specific indication on the delivery document. By signing the courier’s document, the Customer certifies the external integrity of the Product and the conformity of the delivery to their order.

Any defects not evident and not verifiable at the time of delivery (for example: defects relating to the physical integrity of the products inside the package, to the mismatch or completeness of the products received) must be reported within 10 working days from the date of receipt., by contacting Customer Care at servizioclienti@dokito.it who will replace or repair the product.

  1. Invoicing

Dicos Group srl will issue an invoice for each order placed by a customer, whether private or professional and / or company, which has provided the necessary information (tax code and / or VAT number). For the issuance of the invoice, the information provided by the Customer at the time of registration or when placing an order will be used, also providing for the possibility of indicating addresses other than those indicated for shipping. No change in the data indicated on the invoice will be possible after it has been issued.

If the Customer does not provide his / her tax code / or VAT number, Dicos Group srl will not issue an invoice or certify the payment by issuing a receipt or receipt as required by articles. 22, paragraph 1 of Presidential Decree 633/72 and art. 2, lett. oo) Presidential Decree 696/96.

  1. Right of withdrawal

Pursuant to Legislative Decree 06/09/05 N ° 206, the consumer customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, within 14 days of delivery of the products. Although this right is obvious, it cannot be exercised in the event that the delivery has already taken place and for perishable food and / or household products.

To exercise this right, the customer must send a written communication by registered letter with acknowledgment of receipt to the address Dicos Group srl – Via Castelnuovo Parano, 1 03047 (FR) – Italy as well as to the e-mail address info@dokito.it indicating unequivocally the product or products for which it intends to exercise the Right of Withdrawal, as long as it is intact.

Once the aforementioned notice of withdrawal has been received, Dicos Group s.r.l will quickly communicate to the customer the instructions on how to return the goods.

The right of withdrawal is however subject to the following conditions:

Ground coffee: it is possible to exercise the right of withdrawal as long as the product is intact and / or the consumption of which is equal to a maximum of 5%.

Coffee products in pods: it is possible to exercise the right of withdrawal as long as the product is intact and / or the consumption of which is equal to a maximum of 10 pods.

Coffee products in capsules: it is possible to exercise the right of withdrawal as long as the product is intact and / or the consumption of which is equal to a maximum of 10 capsules.

By law, the shipment of products for their return, including the related costs, is the sole responsibility of the customer.

In case of damage to the goods during transport, Dicos Group s.r.l will notify the customer of the incident, to allow him to promptly report to the courier he has chosen and obtain a refund of the value of the goods (if insured); in this case, the product will be made available to the customer for its return, at the same time canceling the request for withdrawal.

Dicos Group s.r.l is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments.

Upon its arrival at the seller’s warehouse, the product will be examined to assess any damage / tampering / contamination with other foodstuffs and not resulting from transport. Furthermore, if the same has not been stored according to the hygiene rules of conservation in force specific to the product category.

Without prejudice to any repair costs for damage to the original packaging, Dicos Group srl – within 30 days of receipt of the goods – will offer the Consumer (who can choose) a voucher for the purchase of a new Dokito product for an amount equal to price of the returned product or the full refund of the price itself.

The right of withdrawal is totally lost, due to lack of the essential integrity of the goods (packaging and / or its contents), in cases where Dicos Group s.r.l and / or the seller ascertain:

The lack of the external packaging and / or the original internal packaging;

The absence of integral elements of the product;

Damage to the product for reasons other than its transport.

In case of forfeiture of the right of withdrawal, Dicos Group s.r.l will return the purchased good to the sender, charging the shipping costs to the sender.

Coffee and other food products guarantee

Dicos Group srl guarantees the quality of coffee and other food products against any material and manufacturing defect up to the expiry date shown on the product itself, provided that its handling and use comply with the instructions, labels and / or other documentation transmitted. by Dicos Group srl. It is understood that food products, once opened, must necessarily be consumed by the date shown on the label.



  1. Force majeure

Dicos Group srl cannot be held responsible if it fails to fulfill the order or if it is delayed due to force majeure (by way of example, but not limited to, production blocks imposed by legislative or administrative measures, epidemics, strikes, severe weather events, fires, floods), even if such events prevent or delay the activity of the courier in charge of delivering the ordered product.

  1. Current law and competent court

These Conditions of Sale are governed by Italian law and in particular by Legislative Decree 6 September 2005 n. 206 (so-called “Consumer Code”) with specific reference to the legislation on distance contracts and other regulations applicable in Italy in relation to sales away from business premises.

For civil disputes, the Judge of the place of residence or domicile of the Customer is exclusively competent, in accordance with the Italian legislation in force at the time of the conclusion of the contract.
